WVVA is in the courtroom and will provide updates as they become avaliable.
BECKLEY, W.Va. (WVVA) - The trial for Natalie Cochran, a woman accused of poisoning and killing her husband has begun.
Jury selection started on Monday, but a juror was replaced on Wednesday because of reported problems at home and allegedly talking to someone about the case.
Opening statements have been made and the first witness has been brought to the stand, with questioning continuing. The trial continued after a recess. The first witness was questioned after recess, and then left the stand.
At 1:39 p.m., the second witness took the stand, and was excused at 2:46 p.m. The trial resumed at 3:09 p.m. after a short recess.
At 3:11 p.m., the third witness, West Virginia State Trooper John Hamilton, took the stand. Hamilton left the stand at 3:30 p.m.
At 3:34 p.m., day 1 of the trial concluded, and will continue at 9 a.m. on Thursday, January 16.
The first time Cochran was indicted, the charges were dismissed until new evidence was introduced into the case. Now charged again, prosecutors contend she poisoned Michael Cochran with insulin.
Opening statements were held and each side got to lay out their plans to the jury about what they hope to accomplish.
Raleigh County Prosecuting Attorney Tom Truman says he has a lot of circumstantial evidence that will show the jury that Natalie Cochran did in fact poison and kill her husband.
Truman conceded that there is no DNA evidence but they have enough to get a conviction.
Truman says he’ll outline how Michael Cochran went from a healthy 38 year old man to dead in a matter of days.
Truman went on to say his theory is that Natalie Cochran killed her husband after he found out about her Ponzi scheme. She’s currently serving 11 years in prison on charges related to that conviction.
Natalie Cochran’s attorney, Matthew Victor called the state’s theory nonsense. He stated he’ll be showing the jury that Michael Cochran was not a healthy man at all.
He says in fact Michael Cochran had been abusing steroids.
A former West Virginia State Trooper and fraud investigator, Robert Hinzman was the first witness to take the stand.
Hinzman testified that the Ponzi scheme seemed legitimate from the outside and from his research Michael Cochran had no idea investors were being taken advantage of by the couple’s government contract business.
Hinzman was cross examined by Victor who pointed to expensive vehicles and jewelry bought by Michael Cochran. Victor also asked Hinzman about cashed checks signed with Michael Cochran’s name.
Jennifer Davis, a family friend of Natalie and Michael Cochran also testified that at one point she offered and gave her son’s insulin to Natalie Cochran after she complained of having high blood sugar.
Davis also said in court that Natalie Cochran had sent her a picture of her husband Michael Cochran, passed out on the floor, seemingly unconscious.
Davis also said Natalie Cochran had made an odd statement to her while Michael Cochran was in hospice. She said she asked Cochran if she needed anything as a way to comfort her, Davis said Cochran responded: “If you could help me hold a pillow over his face because I don’t like seeing him this way.”
Davis was also cross examined by Natalie Cochran’s lawyer who asked her about Michael Cochran’s health history and supplement use.
John Hamilton, a West Virginia State Trooper and family friend of Natalie and Michael Cochran also testified in a civilian capacity on Wednesday. Hamilton testified to being called over to the Cochran household to help lay Michael Cochran down on a couch in the house after Natalie Cochran said he had a seizure.
